Gazipur Correspondent: In Gazipur, Md. Selim has been left destitute after being dragged into a series of false cases allegedly filed by Md. Nurul Islam Sheikh, a self-proclaimed associate of the fascist government, over dominance of Palli Bidyut. He has spent time in jail in multiple cases. Seeking remedy, Selim has submitted applications to various offices demanding justice. His application is quoted verbatim below.Application for Justice Over False Case, Harassment, Defamation and Financial & Mental Loss Without Evidence*I, the undersigned, Md. Selim, son of late Abul Bashar, have been residing in Gazipur for a long time. Several cases were filed under different sections of different laws in the name of Nurul Islam, son of late A. Rahman, proprietor of Bangladesh Friendship Hospital & Diagnostic Center, Rajendrapur Cantt, Gazipur. In C.P. Case No. 55/20 under the Women and Children Repression Prevention Act, the plaintiff filed the case against me though I do not know her. In case 55/20 the plaintiff used only the name "Selim" and in the witness column the father’s name was given as "Gedu Khalifa". My father’s name is Abul Bashar, which is also on my NID card. The NID card was issued in 2006, while the C.P. case 55/20 was filed in 2020 using only my name. If I had known about the incident and the plaintiff of C.P. case 55/20, I would have used my correct father’s name in the witness statement.In Joydebpur Police Station Case No. 9(3)/24, the plaintiff Nurul Islam filed cases in which he was the accused. In the charge sheets and investigation reports of those cases, the investigating officer submitted a report after investigating the plaintiff’s witnesses, neutral witnesses and other circumstantial matters. In that investigation report my name was not mentioned as an accused, witness, abettor or instigator. That means there was no report against me. However, after being discharged from Sreepur Police Station Case No. 89(9)/20 as no truth was found in the investigation report, Nurul Islam filed another case under Section 17 of the Women and Children Act naming me and others, which is illegal. Nurul Islam can file a case in his own name, but without any proof of my involvement he made me an accused.According to law, if the investigating officer submits a final report stating "not found", a case cannot automatically proceed against unnamed persons. To ensure punishment for filing a false case under any law, there must be a full trial in court and witnesses must testify. The investigating officer who submitted the true investigation report must also appear in court to give evidence and be subject to cross-examination.As per law, no investigation report or written document can speak for itself. To prove that report as true, the concerned person must come to court and give oral testimony and face cross-examination by the opposing lawyer. But plaintiff Nurul Islam, without doing so and by adopting dishonest means, filed cases against me under Section 17 of the Women and Children Act and Joydebpur P.S. Case No. 9(3)/24, destroying the peace of my life, defaming me and causing me financial loss.Not only that, Nurul Islam Sheikh also had a female employee of his organization, Nilufa, file a vandalism case against one of his opponents. The investigation proved the case to be false and related to dominance over Palli Bidyut Samity-2. The report was submitted to the court. Later, when Nurul Islam Sheikh filed a _naraji_ petition, the court took it into cognizance and ordered the District PBI to investigate and submit a final report. Abusing influence and with the help of a senior administration official, on 25/9/20 a final report was submitted implicating me as Accused No. 3 in that case.I humbly seek the help of the administration to uncover the full facts and ensure proper justice against this fascist, Nurul Islam.
